Conditions of the 1-year 

warranty extension

Septodont warrants that the Biodentine Mixer (the “Product”) will be free from substantial defects in material and workmanship, and will substantially perform in accordance with the technical specifications set forth in the description of the Product for a 12-month period (the “Warranty Period”) after expiration of the base two-year guarantee granted by the distributor having sold the Product. The disposable parts, such as the fuses are not included in the warranty. The warranty does not apply to any Product that (i) has been tampered with or otherwise altered; (ii) has been subjected to misuse, negligence, malice or accident on the part of the Purchaser; or (iii) has been stored, handled or used in a manner contrary to the packaging specification or Septodont’s written instructions. This warranty is exclusive and in lieu of all other warranties of quality and performance, written, oral or implied, and all other warranties, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose or non-infringement, are hereby disclaimed by Septodont. Purchaser’s exclusive remedy for any defect or deficiency in the Product, whether in warranty, contract, negligence, tort, strict liability, or otherwise shall be a fully compliant replacement Product at no additional cost to the Purchaser.

 

Purchaser shall provide to Septodont written full description of discrepancy or malfunction and send defective Product to Septodont within 15 days following occurrence of the alleged discrepancy or malfunction. Failure by Purchaser to notify Septodont within such 15-day period, will constitute a waiver of claims. In any case, Septodont shall not be liable for any defect appearing after the Warranty Period.
